These Terms of Service ("Terms") govern your use of the website arbalestsolutions.com and any services provided by Arbalest Solutions ("we," "our," or "us"), operated by Rahul Kamlesh Kolge. By accessing our website or engaging our services, you agree to be bound by these Terms.
1. Services
Arbalest Solutions provides three core services within the hospitality vertical:
- Property Management — end-to-end villa management for property owners in Alibag and Neral, India, including listing management, guest communication, pricing, housekeeping, and maintenance
- SEO for Hospitality — search engine optimization for glamping resorts and boutique stays in the United States, including local SEO, technical audits, content strategy, and Google Business Profile management
- Web Development — design and development of direct booking websites for hospitality properties, including PMS and booking engine integration
Specific deliverables, timelines, and fees for each engagement are defined in individual service agreements or proposals shared with the client prior to commencement of work.
2. Client Obligations
When engaging our services, you agree to:
- Provide accurate and complete information required for service delivery
- Grant necessary access to platforms, accounts, and tools as reasonably required
- Respond to communications and requests for approval in a timely manner
- Make payments according to the agreed-upon schedule
- Not use our services for any unlawful or prohibited purpose
3. Payments and Fees
Payment terms, including amounts, schedules, and methods, are outlined in individual service agreements. Unless otherwise agreed in writing:
- Setup fees and one-time charges are due before work begins
- Monthly retainers are billed at the start of each billing cycle
- Property management revenue shares or fixed rentals are paid per the terms of the management agreement
- Late payments may incur a fee or result in suspension of services
All fees are non-refundable once work has commenced unless otherwise specified in the service agreement.
4. Intellectual Property
Unless explicitly agreed otherwise in writing:
- All website designs, code, content, and SEO strategies created by Arbalest Solutions remain our intellectual property until full payment is received
- Upon full payment, clients receive a non-exclusive license to use the deliverables for their intended purpose
- We retain the right to showcase completed work in our portfolio and case studies unless you request otherwise in writing
- Any pre-existing tools, templates, frameworks, or processes used in delivering our services remain our property
5. Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the engagement. This includes business strategies, financial data, access credentials, client lists, and unpublished work. Confidentiality obligations survive the termination of any service agreement.
6. Website Use
By using our website, you agree not to:
- Attempt to gain unauthorized access to any part of the website or its systems
- Use automated tools to scrape, crawl, or extract content from the website
- Reproduce, distribute, or modify any content without prior written permission
- Transmit any harmful code, malware, or disruptive technology
- Use the website in any way that violates applicable laws or regulations
7. Limitation of Liability
To the maximum extent permitted by law, Arbalest Solutions shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our website or services. This includes but is not limited to lost revenue, lost bookings, loss of data, or business interruption.
Our total liability for any claim related to our services shall not exceed the total amount paid by you to us in the six months preceding the claim.
8. Disclaimers
Our services are provided on an "as is" basis. While we strive for the best possible outcomes:
- SEO results depend on many factors outside our control, including search engine algorithm changes, competitor activity, and market conditions — we do not guarantee specific rankings or traffic numbers
- Website performance depends on factors including hosting, third-party integrations, and content — we do not guarantee specific conversion rates
- Property management outcomes depend on market demand, seasonality, property condition, and pricing — we do not guarantee specific occupancy rates beyond what is defined in the management agreement
9. Termination
Either party may terminate a service engagement according to the terms specified in the individual service agreement. In the absence of specific termination terms:
- Monthly retainer services may be terminated with 30 days written notice by either party
- Project-based work may be terminated early, but fees for completed work remain payable
- Property management agreements follow the termination terms outlined in the management contract
Upon termination, we will provide reasonable transition support including handover of access credentials and deliverables.
10. Governing Law
These Terms are governed by the laws of India. For clients based in the United States, individual service agreements may specify alternative governing law and jurisdiction. Any disputes arising from these Terms shall be resolved through good-faith negotiation first, followed by binding arbitration if necessary.
11. Changes to These Terms
We reserve the right to update these Terms at any time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of our website or services after changes constitutes acceptance of the updated Terms.
